Items not included in this Contract are off-site detention; Title Searches; wetland delineations;
environmentally-related permitting; Environmental Impact Statements; lawn irrigation design; structural
design; application fees; geotechnical services; miscellaneous reimbursable expenses; access permits;
backhoe rentals; off-site roadway improvements/widening; land use attorney services; utility extension
beyond the parcel’s frontage; pump station design; state sewer permits; or other permits or activities not
specifically identified herein.
Invoices for Professional Services and expenses incurred shall be generated on a monthly basis
and are due and payable upon receipt. Additionally, attached to this Contract are the Terms and Conditions
of all agreements between our firm and its clients. The attached Terms and Conditions shall form a part of
this Contract and are incorporated herein by reference.
The anticipated fees as identified above include a design and project consulting service for the
subject development based on the information presented to our firm at this time. As previously discussed,
it is our intent to perform the necessary up-front investigation and coordination of work to ensure a cost-
competitive end product. However, as we have all experienced, some municipalities and review agencies
will require revisions to the original plans in order to satisfy their professionals’ preferences and board
comments, which may include unforeseen items. Although we hope this will not be the case, the potential
exists and usually will occur in the form of consultants’ review comments. Typically, based on our familiarity
with this municipality, comments generated from the hearing process will often result in some design and
drafting revisions. For a project of this size, it is generally anticipated that the revisions may range from a
nominal fee to more significant fees, depending on the complexity of the work required.
Bohler Engineering also offers services to prepare various types of exhibits for presentation before
jurisdictional agencies. These are used to enhance testimony and to provide a graphical representation of
the project. Exhibits include, but are not limited to: computer-generated color renderings of the Site Plan
with illustration of landscaping, photo-realistic imaging of the project utilizing an actual photograph as
background and a computer-generated isometric illustration of the project, aerial photography (which may
also include overlay of the project), lighting exhibits detailing photometric statistics as well as a graphical
