No such substance taken under this Article shall be exported by the Company.
In the event that any land in Abu Dhabi required by the Company belongs
to a private individual or company the Ruler will lend every reasonable assistance
to the Company in order to acquire for its use such land at prices ruling for similar
lands in the district.
The Company shall have the right to use free of royalty payments, all oil,
gas and other kindred substances produced by it from the concession area and used
in its operations hereunder.
Article 11
The Company undertakes to respect the rights, privileges and sovereignty of
the Ruler and the persons, property and rights of his subjects. And it undertakes
further to refrain from doing or causing to be done any act which offends against
the laws and customs of the country.
The Company’s operations shall be conducted with due regard to the character
as high seas of the sea overlying the concessional area. In particular the Company
undertakes that, in the exercise of its rights and fulfilment of its obligations under
this Agreement, it will interfere to the minimum extent possible with, and will take
adequate precautions for the protection of, navigation, fishing and pearling; and
that it will comply with all reasonable requirements of the competent authorities
of Abu Dhabi affecting fishing, pearling and the navigation of ships and aircraft.
Article 12
Steamers carrying Abu Dhabi Government goods may use harbours con
structed by the Company in such a manner as not to interfere or conflict with the
Company’s operations or their safety.
Article 13
In return for the obligations assumed by the Company under this agreement
and for the payments required from the Company hereunder, the Company shall be
relieved of all obligations to pay taxes, imposts, charges, fees and duties, direct and
indirect in any form. It is understood that this privilege shall not extend to com
modities and provisions imported by the Company, such as food stuffs, drinks,
clothing, cigarettes and similar articles for personal consumption. Nor is the
Company entitled to sell or to hand over to anyone any item which it has imported
for its operations without having first paid any duty chargeable on such items when
necessary.
Article 14
The Company shall provide the Ruler and his Representative with all possible
assistance and facilities in Abu Dhabi in connection with the use of the Company’s
means of transport, e.g., roads, railroads, boats and aircraft, and wireless com
munications, &c., when required, free of charge.
Article 15
The Company shall furnish free of cost to the Ruler annually from the date of
signature of this Agreement, until the construction of a refinery in Abu Dhabi to
refine the oil discovered in the concession area 8,000 gallons of petrol and 20,000
gallons of kerosine the first delivery of said products to be made one year after the
date of signature of this Agreement. After the construction of a refinery as afore
said the Company shall similarly supply the Ruler with 20,000 gallons of petrol and
40,000 gallons of kerosine.
Article 16
In the event that the Company forms an additional company for the purpose
of refining in the Sheikhdom of Abu Dhabi any portion of oil produced under this
Agreement then the Government of Abu Dhabi shall have the right if it wishes to
purchase for cash annually from such refining company 1,000,000 gallons* of
kerosene, 500,000 gallons of gasoline and 1,000,000 gallons of road oil, the purchase
price of such products to be 25 per cent, under the current price for which such
products are being sold locally at the Refinery.
The Government of Abu Dhabi agrees to restrict its purchases of such products
at such reduced prices to actual requirements within the country and will not
permit export or re-sale outside the country.
