any payment from the settlement but will still give up their rights to sue USF over fuel surcharges.
It is not advisable to do nothing.
The settlement proposed consists of $2,575,000. The settlement proposes that the attorneys
receive 33.3% of the settlement amount and reimbursement of expenses up to $100,000. In
addition, the settlement proposes to pay each one of the six named plaintiffs $15,000. Therefore,
the total settlement proposal to be divided among the Settlement Class is $1,527,000 ($2,575,000
less $858,000 (attorney fees) less $100,000 (attorney expenses) less $90,000 (6 named plaintiffs).
The portion that any Applebee’s or IHOP operator would receive will be determined on a pro-rata
basis by the settlement administrator appointed by the court if the settlement proposal is approved.
The total amount of the fuel surcharges the operator paid as a percentage of the total amount of
fuel surcharges paid by all Settlement Class members who submit a claim form will determine the
operator’s percentage share of the net settlement fund after expenses. The total amount of any
payment will depend on how many other class members submit claim forms.
Since CSCS was formed in February 2009 fuel surcharges have been monitored for accuracy for
contracts negotiated by CSCS.
