2. The Village shall contract for completion of the Work on the Property. Owners
hereby grant permission for Village representatives and the Village’s chosen contractor to enter
onto the Property with all necessary personnel and equipment and to undertake and complete the
Work in a good and workmanlike manner, including the right to remove any objects impeding
necessary access to complete the work. Owners acknowledge and agree that neither the Village
nor its chosen contractor shall be responsible for resodding the area disturbed by the Work.
Owners acknowledge and agree that the Village is not affording Owners any warranty as to the
Work, and that the Village’s contractor’s warranty shall be limited to the terms of its contract
with the Village. The repaired lateral shall remain Owners’ property and the cost of any and all
future maintenance or repair shall remain Owners’ alone. Owner hereby agrees to indemnify the
Village against any and all liability of any kind from or relating to the Work or from or relating
to this Agreement.

2. The cost of the Work is anticipated to be $3,900, although Owners acknowledge
and agree that such amount could change, were additional costs to be incurred and approved
under the Village’s contract. Owners agree that the Property is and will be benefitted by the
Work, and Owners agree to the imposition of a special assessment against the Property in the
total amount of the final cost of the Work. The special assessment will be an active (not
deferred) special assessment, and shall be payable by Owners in five equal, annual installments
on the tax roll of the property, beginning with the 2018 tax roll. No interest shall be charged on
the special assessment.

3. Owners’ intent in executing this Agreement is (i) to consent to the imposition of a
special assessment on the Property, as described above; and (ii) to waive, pursuant to Wis. Stat. §
66.0703(7)(b), the procedural rights that Owners otherwise would have, under the laws of the
