RESOLUTION BY THE PUBLIC WORKS AND CAPITAL IMPROVEMENTS COMMITTEE
AUTHORIZING ENTERING INTO AN AGREEMENT WITH DONALD & LISA KLEIN FOR

THE IMPOSITION OF VOLUNTARY SPECIAL ASSESSMENT AND WAIVER OF
STATUATORY PROCEDURES REGARDING SAME

WHEREAS, there is a failing sewer lateral at the property located at 2820 87th Street,
which has caused a sinkhole that is adversely impacting the abutting public right-of-way; and

WHEREAS, the property owner is responsible for repairing/replacing the failing sewer
lateral; and

WHEREAS, the property owners have requested that the Village undertake the work
of repairing of or replacing of the sewer lateral at the owners expense, to be paid over a five-
year special assessment against the Property.

WHEREAS, the Board of Trustees has determined that it would be in the best interest
of the Village to replace the sewer lateral, at the owners expense, in order to repair the
sinkhole.

NOW THEREFORE, the Village Board of the Village of Sturtevant, Racine County,
Wisconsin does hereby resolve:

1. That the execution an Agreement for Imposition of Voluntary Special
Assessment and Waiver of Statutory Procedures Regarding Same, as set
forth in Exhibit A, which is attached hereto and incorporated herein is
authorized and approved.

2. That the Village President and the Village Clerk are authorized to sign any
agreements or other documents necessary to carry out the intent of this
resolution.

Adopted by the Village Board of the Village of Sturtevant, Racine County,
Wisconsin, this 17th day of July, 2018.
