*Rules & Regulations
The following Rules & Regulations are in addition to rules, regulations, and restrictions found in the condominium documents, state statute, administrative code, city, county and federal law.
ADMINISTRATION:
BOARD OF DIRECTORS & COMMITTEES
The powers and duties of the Board of Directors and Officers may be found in the condominium documents, state statute, and administrative code. In addition:
1. La Mer’s Board of Directors is the governing body of the association. Each board member is elected to serve a two year staggered term. Each unit owner is allowed to run for an unlimited number of consecutive terms. Any unit owner in good standing may run for election to the Board of Directors.
2. The Board of Directors is responsible for the maintenance of the common elements, administration of the business affairs of the association, operation of employee services, and establishing reasonable rules & regulations for the safe and proper use of common elements. The Board of Directors may appoint committees and/or hire a manager or management company to assist in these duties.
3. The Board of Directors shall appoint a committee to screen and review applicants wishing to purchase and/or lease a unit in La Mer. Members of the committee shall have full authority to act on behalf of the Board of Directors in approving or denying an application for purchase or lease.
4. Unless granted additional authority by the Board of Directors, committees appointed by the Board of Directors shall not have the authority to disburse funds, make policy, or take final action on any matter. Committees seeking final action on matters must submit their recommendations to the Board of Directors for final approval.
5. Officers and individual members of the Board of Directors are not empowered to speak on behalf of the entire Board. Board decisions and actions must be voted on at a duly called meeting and recorded in the official minutes of the meeting.
MEETINGS
Specific requirements for meetings may be found in the condominium documents, state statute, and administrative code. In addition:
1. Annual Meeting: An annual membership meeting will be held each year for the purpose of
conducting an election of new members to the Board of Directors along with any other issues properly brought forth by members of the association. The annual membership meeting is open to all unit owners.
2. Board Meetings: The Board of Directors shall determine the time, date, frequency and agenda of meetings. Notice will be posted and/or mailed as required by condominium documents and state statute. Board of Director meetings are open to all unit owners.
3. Unit owners shall be permitted to speak at meetings in reference to any agenda item. Any unit owner shall have the opportunity to speak on any agenda item before a vote on the item is taken and each speaker may be limited to three (3) minutes on any single agenda item.
4. All persons requesting audio/video privileges must register in the management office at least twenty-four (24) hours prior to the starting time of the meeting. Recording areas will be designated by management. All audio/video equipment must be capable of recording in existing room conditions. Spot lighting, external cabling and extended microphones are prohibited. Use of audio/video equipment shall at no time cause to disrupt or interfere with the proceedings of the meeting by way of noise, movement, blocking of view, or placement of equipment.
MANAGEMENT
1. Management shall take directive from decisions voted on and approved by the Board of Directors. Management shall provide periodic reports to the Board of Directors concerning the status of the business affairs of the association, the status of the common elements, and the status of employee services.
2. Management shall act on behalf of the Board of Directors to hire and fire all association employees and shall direct and supervise all employees providing services to the association.
