*Rules & Regulations
The following Rules & Regulations are in addition to rules, regulations, and restrictions found in the condominium documents, state statute, administrative code, city, county and federal law.
3. Management shall direct and supervise the daily operations and business affairs of the association.
4. Management shall schedule, supervise, and direct the repair, replacement, and maintenance of common elements to the extent made possible by available funding provided by the Board of Directors.
5. Management shall direct and supervise the enforcement of rules and regulations and shall act on behalf of the Board of Directors to investigate complaints, send letters of violation, and initiate legal action until the matter of the violation has been resolved or the Board of Directors issues a directive to cease further action.
6. Management, or any agent delegated by Management, shall have the authority to enter any unit for the purpose of inspecting, maintaining, repairing, or replacing any common elements or any portion of a unit to be maintained by the association or as necessary to prevent damage to the common elements or to a unit or units. (718.111, (2), (5).
7. Management shall act as liaison between the members of the association and the board of directors in attempting to resolve questions and/or complaints.
UNIT OWNER INQUIRIES
1. Inasmuch as Florida Statute 718.112 (2) (a) entitles the association to adopt reasonable rules and regulations regarding the frequency and manner of responding to unit owner inquiries, one of which may be that the association is only obligated to respond to one written inquiry or request per unit in any given 30 day period, that the preceding be adopted, and henceforth the association is only obligated to respond to one written inquiry or request per unit in any given 30 day period.
2. Unit Owners or their designated representatives may inspect the official records of the association by written request to management. Requests must be specific in nature. All inspections will take place in the management office at a time agreed upon by management so as not to interfere with the daily operations. Original documents may not be altered or removed from the management office. If management is requested to make copies of documents there will be a charge of 10 cents per page.
VIOLATIONS / FINES
1. Management shall direct and supervise the enforcement of rules and regulations and shall act on behalf of the Board of Directors to investigate complaints, send letters of violation, and initiate legal action until the matter of the violation has been resolved or the Board of Directors issues a directive to cease further action.
2. The Board of Directors shall have the authority to establish a Rules Enforcement Committee and appoint association members who are not members of the Board of Directors to the committee. The Rules Enforcement Committee shall review complaints of violations, determine if a violation has occurred, and either dismiss the case or recommend to the Board of Directors that a fine be levied against the unit.
3. The association, by and through the Board of Directors, may levy reasonable fines against an occupied unit for the failure of the owner of the unit, or its occupant, licensee, or invitee, to comply with any provision of the declaration of condominium, the association by-laws, or reasonable rules of the association No fine shall exceed $100.00 per violation. However, a fine may be levied on the basis of each day of a continuing violation, with a single notice and opportunity for hearing, provided that no such fine shall in aggregate exceed $1,000.00.
4. Nothing herein shall be construed so as to limit the rights of the Board of Directors to pursue other legal means to enforce the provisions of the declaration of condominium, the by-laws of the association, or the rules and regulations, including action for damages and injunctive relief.
