Your obligations in terms of the CPA.
You are required to notify the tenant in writing not more than 80 days, nor less than 40
business days before to the end of the lease of its impending expiry date. If you do not wish
for the lease to continue or be renewed, you must specifically notify the tenant of this and
invite them to an exit inspection within 3 days of the expiry of the lease. Should you wish for
the lease to continue, you must invite them to renew the lease and then include in the above
notice any material changes (increase in rent and deposit, or any other changes to the lease)
that would apply if the agreement is to be renewed as well as advising them of the options
available to the tenant to either accept the renewal for another fixed period, or they can
cancel the agreement without penalty on the expiry date, or that the agreement can
continue on a month-to-month basis, but subject to your material changes.
BE AWARE that the lease agreement will
automatically continue on a month-to-month
basis, subject to any material changes of
which the landlord has notified the tenant in
writing, unless the tenant has expressly:
Directed the landlord to terminate the
agreement on the expiry date
Agrees to the renewal of the agreement
for a further fixed term
WHEN THE LEASE ENDS
The lease will end on the expiry date should it have been expressly terminated by either the
landlord or tenant – via written notification to the other party.
The tenant must vacate the property at the time stipulated in the lease agreement, on or
before the last day of the lease. The tenant must also return the property in the same
condition as the tenant received it, fair wear and tear excluded.
The landlord and the tenant must arrange a joint inspection at a mutually convenient time,
within 3 days prior to the expiry, with a view to ascertaining if there was any damage caused
to the property during the tenant’s occupation. PLEASE NOTE – it is however both practical
and advisable to do the exit inspection once the tenant has moved their furniture out. You
would have done the entry inspection when the property was vacant, so do the exit when it
is vacant and furniture cannot be used to potentially cover up damage.
