       Gender Based Violence



              The Urgency of Women Protection From Sexual Violence:


              an Analysis of the Current Regulations in Indonesia

                     The      purpose           of    the     Indonesian            State       listed      in    the     constitution             is   to    protect        the      entire

                     Indonesian  people.  One  form  of  protection  for  citizens  is  the  protection  of  the  right  to  be  free

                     from  threats  and  violence.  But  in  fact  in  the  last  three  years  cases  of  sexual  violence  tend  to

                     increase.  During  the  period  of  2019  there  were  3,528  cases  of  sexual  violence.  After  draft  of  the

                     Women's  Violence  Bill  (RUU  P-KS)  fails  to  be  ratified  by  the  DPR  from  2016  to  2020,  it  should

                     be  further  examined  and  analyzed  how  the  consequences  and  impact  on  efforts  to  protect
                     women            from       violence.         As    well      as    any      efforts       that      have       been       made         by     the     Indonesian

                     government  to  take  preventive  and  repressive  measures  against  cases  of  sexual  violence  that

                     afflict  women.  This  study  seeks  to  examine  juridical  rules  related  to  the  protection  of  women

                     both       in   the     realm        of   legislation         and      policies        made        by    the     Government.               This     study      uses      a

                     normative  juridical  approach.  The  results  of  this  study  conclude  that  there  are  no  laws  and
                     regulations  in  Indonesia  that  specifically  deal  with  sexual  violence.  The  existing  regulations

                     such as KUHP, the Law on the Elimination of Domestic Violence and etc have not been able to

                     specifically address sexual violence.
