P. 21

8. i) Three months ago, you went on holiday with friends who had

free use of a luxury villa. You stayed rent free. Today you find out that

the villa was owned by a person who was the claimant in a case in

whose favour you ruled last week. What do you do?

ii) Would it make any difference if a) your friends had paid rent? b) You

                                 had paid rent?

                   9.

                          i) You notice that one of your colleagues is about to go into court. He is

unsteady on his feet, he is talking to himself and his speech is slurred

and his breath smells of alcohol. He is clearly drunk. What do you do?

ii) Would your answer be different if you merely smelled alcohol on his

                                 breath?

iii) Would your answer to i) above be different if you knew he was on

medication which could perhaps affect his breath and demeanour?

                   10.

                          i) You have heard a colleague making seriously sexist remarks in the

judges retiring room. You know that he is due to try a serious case

involving sensitive issues relating to sexual discrimination. What do

                                 you do?

                   11.

                          i) A colleague of yours who has got behind with his judgements asks you

for help in writing the judgement for him. How do you respond?

ii) Would your answer be different if he wanted you to write the legal

                                 aspect only?

                   12.
