i)     You are behind in your judgement writing. Your law clerk has made

                                 notes of the hearing, has prepared a memo for you setting out the


                                 arguments and reaching a conclusion as to the decision to be taken.

                                 Can you a) use the clerk’s notes of evidence b) use the “draft


                                 judgement”?

                          ii)    You gave your decision on the case in open court but reserved your


                                 reasons to another day. When you sit down to write the judgement, you

                                 realise that you have come to the wrong conclusion and that you

                                 should have come to the opposite conclusion. What do you do?

                          i)     The court clerk tells you that the Claimant (a litigant in person) failed


                                 to submit his documents to the court in time and the reason for this was

                                 because he was in prison. However, he does not want the court to


                                 know the real reason as he thinks that it will prejudice the judge

                                 against his case. What do you do on being given this unsolicited

                                 information?
