SCENARIO

DISCUSS

 The defendant was charged with rape of and

incest with his two daughters. There was

evidence that he had engaged in incest over a

long period, that he had used force and

threatened both girls unless they observed

silence and that he had paid for abortions for

both of them. At his trial he applied for the counts

relating to each daughter to be tried separately.

The trial judge refused the application and all

charges were heard together.
