Any Controlled Substance Violation, Abuse of an Elder or Disabled, Extortion, Sexual activity with a Child 12-17, Indecent Assault or Act in the Presence of a Child under the age of 16.
If you have recently been arrested for one of these crimes, you are not eligible to apply for a concealed weapons permit until the case is over and the applicable waiting periods have been met under the law.
Medical Marijuana
Marijuana is rapidly becoming a mainstream product in society. As of 2018, 10 states have legalized marijuana for recreational use and 33 states have legalized it for medical use. The real question is can I own firearms or obtain a Florida concealed weapons permit if I am using medical marijuana? I wish the answer was a simple yes or no, but why would anything our government does be simple?
At the federal level, marijuana is still illegal, and even if your state has legalized it, users are still considered illegal drug users by the feds. This automatically makes you a prohibited person when it comes to firearms. A prohibited person is someone who is not allowed to purchase or possess firearms in the United States. If you’ve purchased a firearm recently, you probably noticed an update on ATF form 4473. This is the document you must complete to purchase a firearm from a gun dealer. Question 11e asks “Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?” Then, at the bottom, it continues: “Warning: The use or possession of marijuana remains unlawful under federal law, regardless of whether it has been legalized or decriminalized for medical or recreational purposes in the state where you reside. So we now know that you cannot legally own or possess firearms as a marijuana user, but surprisingly, the state of Florida will still issue you a concealed carry permit. So, you can have a permit to carry a gun concealed, but you can’t legally touch a gun. That makes sense.
How to Apply for the License
After you complete your concealed carry permit course, you will need to submit your application to the State of Florida. Applying for your permit is fast and easy if you follow the four steps I’ve listed for you below. I’ve had many students over the years who get distracted and start taking information from other sources, and they end up choosing the difficult way to submit an application.
