Retaliation
There are certain things employees have a legal right to do, things that are
sometimes understandably inconvenient to the employer, but for which the
employee cannot be punished. Examples include:
• Reporting a workplace safety concern to state or federal authorities;
• Reporting a workplace injury and/or applying for workers’ compensation;
• Requesting or taking leave under the Family Medical Leave Act;
• Making a complaint (within the company or to authorities) about sexual
harassment and/or discrimination in the workplace;
• Making a complaint (within the company or to authorities) about not being
paid their agreed wages, overtime, or commissions;
• In some instances, making a complaint about an employer’s violation of the
law (commonly called “whistle-blowing”);
• Taking time off of work to serve on a jury; and
• Using earned sick time under the Massachusetts Earned Sick Time law.
