The leave does not have to be paid, though
employers sometimes provide paid leave through
short term disability insurance policies or
otherwise as an additional benefit.
The leave does not have to be taken all at once.
An employee might take two weeks of leave at the
beginning of the year due to illness, another two
weeks later in the year to care for a family member
with an illness, and another 8 weeks for the birth
of a child. So long as the employee does not use
more than 12 weeks total, the FMLA continues to
apply.
The employer can require reasonable
documentation of the illness in order to approve
the leave.
