HOW TO PROTECT A DESIGN
1 2 3 4 Decide when to file an application
A design needs to be new to get registered. As a consequence, defining how and when to protect the product features or the branding elements is crucial. If you are still in the creation phase and it is pro-
bable that changes will still occur, the design should not be disclosed through an early registration.
1 2 3 4 Crafting adequate representations
The aim is to optimize the scope of protection.
The representations of the design should clearly show all visual characteristics to be protected and from different angles. In addition, variations of the design should be included in the registration to achieve broader protection. The representations are to be prepared by Marketing or the commissioned design agencies.
