GLOSSARY
Adjudication - The deliberation process in which the validity of an unemployment claim is determined .
Affirmed - An action or decision by the appeal body which agrees with a previous decision .
Appeal - The protest of a determination or decision rendered by the state regarding an unemployment case .
Appeal deadline - The amount of time allowed by the state to respond to this document .
Base Period Employer (BPE) - The claimant’s employer during the period used to determine benefit entitlement,
but was not the last employer .
Claim Date - The beginning date of the claim as determined by the state . This date is usually later than the
claimant’s date of termination .
Collateral Estoppel - Doctrine which allows the use of a decision from a legal proceeding involving the same
issues and parties to be used in further litigation .
De Novo - A decision made upon review of information or testimony and is not based upon any previous
decision by another authority .
Disqualifying Wages - Wages paid to the claimant which the state may deduct from benefits .
Extended Benefits - In recession times, the government and/or states can extend benefits if both the claimant
and state meet specific criteria for eligibility .
Good Cause - In voluntary quit case, a compelling reason that can be attributed to the employer . In a discharge
situation, willful and deliberate misconduct by the employee .
Hearing - The first level in the unemployment appeal process . The employer and claimant appear before a state
hearing officer to present testimony and evidence regarding the unemployment issues .
Hearing Officer - The state officer who oversees and makes the decision regarding an unemployment hearing .
Misconduct - A willful and deliberate act displaying a disregard of the employer’s interest or negligence that
could jeopardize the safety or property of the employer or the claimant’s co-workers .
Minimum Weekly Benefit Amount - The least amount of unemployment compensation the claimant may collect
on a weekly basis .
Maximum Weekly Benefit Amount - The highest amount of unemployment compensation the claimant may
collect on a weekly basis .
Maximum Liability - The maximum amount an employer will pay if a claimant collects benefits for the full
duration of time .
Partial Benefit Calculation - Unemployment compensation paid to an individual who is working less than full-
time . Benefits are reduced based on the claimant’s part-time weekly earnings minus any earnings disregard .
