E-Verify Results
Upon completion of the Form I-9, I-9 Express will automatically process E-Verify . The initial verification will return
one of three results in seconds .
1. Employment Authorized: The employee is authorized to work . In this case, click “close case” and
follow steps .
2. SSA Further Action Notice (FAN): There is an information mismatch .
3. DHS Verification in Progress: DHS will respond within 24 hours with either:
a . Employment Authorized .
b . DHS Further Action Notice (FAN) .
What is a Further Action Notice (FAN)? A FAN means that information from an employee’s Form I-9 did not match
government databases .
Common Reasons for FANs:
• Social Security number (SSN) does not match
• Identification document could not be verified
• Citizenship or immigration status has recently changed
• Name change was not reported
• Name entered on I-9 is different than what is recorded in government databases
• Information was not entered correctly on Form I-9
Handling a FAN
1 . Promptly inform the employee of the FAN .
2 . Review the information in Section(s) 1 and 2 with the employee for accuracy .
3 . Print the FAN and give it to the employee . The employee has the right to contest the FAN .
• If the employee chooses to contest the FAN, a Referral Date Confirmation (RDC) process is triggered .
1 . Click contest and follow the steps .
2 . Print the RDC and give it to the employee .
*The RDC includes the exact date the employee must visit the SSA office or contact DHS .
Note: It is illegal to discriminate against any work-authorized individual in hiring, discharge,
recruitment or employment eligibility verification (I-9 and E-Verify) . The employee may
continue to work until the deadline stated in the RDC. Once the deadline elapses, we are
not authorized to employ the individual.
• If the employee chooses NOT to contest the FAN .
1 . Click non contest and follow the steps .
2 . Close the case and select the following reason “The employee chooses not to contest the
FAN .” Note: The employee may not continue to work .
