make further disclosure. He thought he would have to disclose and expose the fact
that he hadn't told Kingsley Napley the truth. He wanted to get it off his books. The
evidence we have of that is very strong.
MF The logical conclusion of that is that he did not really intend to make an unconditional
gift to Louise. Why did you tell the court it was a loan?
MC Anthony said it was a gift, we didn't know whether it was a loan or a gift.
MF One of my jobs is to advise you and one is to represent you - some of what I say you
may not like, but then we come up with a strategy. Lou knows from when I first met
her that I need to test the evidence. You say you didn't know it was a loan or a gift,
but the sworn evidence in the family proceedings is that it was a loan
MC It didn't come up at the time until Anthony said it was a gift and therefore an asset of
Louise's which should be taken into account. That came as a shock to us. We hadn't
thought about it. There's a conversation that was had between Sig and Louise on 6
March where he said, "fuck off, it is nothing to do with me." We weren't sure, we
explained it as best as we could in the evidence at the family court. I thought the Form
E document was more important than the statements. He would not say either way,
that is why the statements are confusing. We didn't know why he was being so
difficult. He could have just said it was a loan.
MF So if we assume it was a loan - why not give it back?
LS What are the terms of the loan if that is the easel
MF If it wasn't a loan, Louise would say, "you never told me it was a loan, I thought it was
a gift to get Anthony off our backs."
MC When we saw Richard Bolton, we had a dilemma on one hand saying it was not a loan
and on the other saying it was. We invited Sig to that meeting, but he said he wouldn't
come. The barrister just said it is what it is, the court has to decide.
MF OK, so we say it was a gift.
MC To get it off his books and to hide it. He was terrified he would be under surveillance.
He had asked me about validation of claims and how that happens. He was worried it
would come out to Kingsley Napley/Diamond Insurance. The whole purpose was to
deceive Diamond.
MF What would have happened to the outcome of his claims if Diamond had known?
MC They wouldn't have paid him. It would have been doubled up. The most important
thing is what was going through his mind at the time.
MF And what do you want to get out of this?
LS He should just walk away.
