Associates may not solicit other associates for any purpose at any time, including Non-Working Time, while in Resident Care/Service Areas, However, this prohibition does not apply to any effort that is directly related to the operation of the location, division, such as Company-sponsored fund drives (i.e. to purchase a television set for residents) or charitable organization activity (such as the Alzheimer’s Foundation or Alzheimer’s Fund), or resident functions (such as a bake sale or jewelry sale), as long as those activities are approved by the Company. Contribution to Company- sponsored or charitable institution drives is strictly voluntary and associates will not be discriminated or retaliated against because of their willingness or unwillingness to participate.
Solicitation and Distribution by non-associates will not be permitted on Company Property by, for or on behalf of any individual, organization, group or society.
ENGLISH COMMUNICATION
Although it is the policy of the Company to encourage diversity and inclusiveness and to prohibit all forms of discrimination, there are some occasions when, due to safety reasons and business necessity, the Company will require associates to converse, communicate and take direction and guidance in English. As such, and in order to ensure the safety of residents, family members, visitors and other associates, to promote quality customer service and create optimal performance, Associates are required to speak, communicate and take direction in English in the following situations:
o When associates are on duty, in resident care or service areas and/or when on duty in the presence of residents and/or resident family members and visitors.
o When interacting with co-workers, team leaders, residents, family members, guests or vendors who communicate only in English or who express a preference or expectation that the associate communicate in English.
o When performing job duties, unless the associate is outside the presence of residents and family members, and the associate is not interacting with other associates, guests, vendors or visitors who communicate only in English or who express a preference or expectation that the associate communicate in English.
o In the event of an emergency.
Associates are free to speak their native and/or foreign language(s) during rest breaks, meal periods, and while on personal telephone calls, provided that said calls comply with Company policy concerning Cell Phone use. Associates must be considerate of other staff members who may be present and do not speak the associate’s native language.
If a resident does not speak English as his or her primary language, and an associate is able to speak and communicate with the resident using the resident’s primary language, associates are permitted to communicate with that particular resident in that native and/or foreign language, as long as it does not cause any disruption.
Associates having concerns or questions regarding this policy should address them with the Company Human Resources representative or the Community Leader.
SEARCHES, SURVEILLANCE & INSPECTIONS/Expectation of Privacy
The Piper is equally committed to ensuring a safe and secure environment for, and protecting the personal property of, its residents, family members, Associates, guests, vendors and visitors. As such, the Company reserves the right to install video surveillance equipment at its locations and to conduct searches of Company property and Associates’ personal property, in accordance with applicable federal and state law. This Policy does not apply to the surveillance activities of law enforcement agencies engaged in a lawful investigation on Company premises.
