in violation of this policy will be terminated. The first time an
employee tests positive for alcohol or illegal drug use under this policy,
the result will be discipline up to and including termination of
employment.
Employees will be paid for time spent in alcohol/drug testing and then
suspended pending the results of the drug/alcohol test. After the results
of the test are received, a date/time will be scheduled to discuss the
results of the test; this meeting will include a member of management.
Marijuana Use
North Dakota law allows for the controlled use of medical
marijuana. Although employees who legally obtain a medical
marijuana “registration card” from the North Dakota Department of
Public Health are allowed to possess and consume certain quantities of
marijuana, doing so is not permitted on Company property or at
Company sponsored events (either on or off Company property).
Marijuana is classified as a Schedule I drug according to the Controlled
Substances Act. Thus, the use, possession, cultivation, or sale of
marijuana violates federal policy. FMCSA prohibits the use of
marijuana (even if a medical card has been obtained) for individuals
that have a Commercial Driver’s License (CDL).
Workplace Searches
To protect The Company property and to ensure the safety of
all employees, the Company reserves the right to inspect and search all
company property including but not limited to: any employee’s office,
desk, drawers, cabinets, files, locker, equipment, including computers,
email and voicemail, Company vehicles, and any area on Company
premises. In this regard, it should be noted that all offices, desks, file
drawers, cabinets, lockers, phones, pagers, computers and other
Company equipment and facilities are the property of the Company
and are intended for business use. Employees should have no
expectation of privacy with respect to items brought onto Company
property and/or stored in Company facilities. Inspection may be
conducted at any time with or without notice at the discretion of the
Company.
