        a Bach, Yoreh Deah 181 אפק ד״וי | ח"ב . 37

The explanation of his words [the Smag] is as follows: If it is
true that there is a measurement [that must be left of the pe’ot, השק ןכ םא ם"במרה בתכש ומכ האיפל
in which case one is not liable] for the pe’ah as the Rambam
writes, that is difficult, for certainly if one cut two hairs from
the temple, one would not be liable as one who cuts two hairs
on Shabbat… Rather, it must be that it [the Tosefta] is referring
to where he shaved all the hair off and only left the minimum
measurement of hair, and he says about this it was said that if he
cuts two of the hairs that remain, he would be liable.
this needs to be resolved, for if the Rambam is correct that
the measurement of the pe’ah is four hairs, why is it stated that
if he cut two hairs he would be liable? Surely even if he pulled
one hair he would be liable, since the minimum measurement
that must remain no longer exists. And if you say that if he pulled
one hair he is exempt since three hairs remain, if so then from
the outset let the measurement be three hairs.
say that the Sages didn’t give a measurement for the amount 'גב יגסיל ימנ הלחתכל ןכ םא תורעש 'ג
of [remaining] hairs [as opposed to the Rambam who holds]
there is a measurement. Rather, one must leave all the hairs
that grew in the area of the pe’ah both in width and in length.
Therefore, if one cut two hairs, one is liable for transgressing “do ולדגש תורעשה לכ חינהל ךירצ אלא רבדל
not round.” This is the opinion of the Smag without a doubt,
and [although] the Beit Yosef questioned the Smag, there is
no difficulty at all.

According to the Rema and the Bach, the Smag holds that there is no measurement, and his ruling is that it is
forbidden to cut any two hairs of the pe’ot.
                                                      4
The Tashbetz suggests that the measurement of forty hairs may come from the calculation of the amount
of hairs found in the measurement of a gris, which is half of the size of a type of bean, and its size is the
minimum size of a mark of tzara’at (leprosy) that renders a person impure, as well as the minimum size of a
stain of menstrual blood that renders a woman impure as a nidda (menstrual cycle).

And some wrote [about the Rambam’s opinion] that it needs
further study. But I researched it further and it seems to me that
the elders derived this from the measurement of pulling one hair

        4. The Tashbetz writes (elsewhere in the same responsum) that he believes the correct text of the Rambam is a measurement of forty hairs, and he
offers his suggestion of the source using this assumption.
