e) hopefully we have proved conclusively that no consensus nor majority existed save in emails sent by one or two lessees purporting to represent others but with no confirmation nor evidence of such from any of the “others” despite our insistence they identify themselves directly to MHML and indeed make written confirmations or com- mitments when emailed by MHML requesting same. None was ever forthcoming, save for when MHML raised the issue of a late, cheaper (cheapest) tender from Benitor. Mrs Hillgarth then did arrange a very prompt, almost by return reply from her virtual majority stating uncontrovertibly they rejected our suggestion. This prompt and explic- it situation [admittedly totally orchestrated by Mrs Hillgarth with a template for others to simply follow but with a necessity for them to write individual email confirmations] adds credence to our assertion that no individual lessee [as in this case re Benitor] had authorised Mrs Hillgarth (or any other lessee) as their spokesperson nor given Mrs Hillgarth nor any other lessee their proxy vote. By insisting on this one occasion regarding the Benitor tender to confirm categorically in writing their opinion does evidence it could have been, should have been possible to arrange a single majority spokesperson with confirmed proxy authority.
As we have stated, there never was one and despite MHML’s many requests to all individual lessees for various confirmations as to agreement or not on various aspects, most notably funding and decor, none was ever forth- coming to ascertain any consensus whatsoever. We either did not receive back a reply or when we did, the replies were never of a consensual nature and usually raised yet further issues requiring yet further clarification, most notably Flats 3, 5 and 9.

renovation of the door/window partitions on each floor, the front entrance portico renovation, the brassworks throughout Mitre House, the mail basket, the mail pigeon box hall table, the silver fire extinguishers, the brass and luminous signage throughout Mitre House and on exterior where required, the various brass additions to polished wood panelling and brass buttoning throughout Mitre House, the boxing in of the loose wiring on each floor, the meter cupboards transformation on each floor, the front entrance signage, the various mats and floor protectors throughout Mitre House including in lift car, the crittall window renovations (still ongoing I regret), the lift mirroring, trellis and fixtures, the No Smoking signs, the brass advice plaques throughout Mitre House and lift areas, the replacement locks to all rear doors, the solid brass door stops on all doors throughout Mitre House (one of which damaged Mrs Hillgarth’s interior bathroom wall which MHML paid for the repair on receipt of Mrs Hillgarth’s £145 invoice I recall) - the various mirrors and artifacts in common areas (I dare not mention the 60 framed artworks, 12 Yucca plants with stands, the window boxes in yard area with multiple plants and topiary for the enjoyment of those flats overlooking the rear of Mitre House (which includes Mrs Hillgarth’s flat, and indeed her two pals, Flat 3 and Flat 9) - plus major cleaning down and stone polishing of stairs and balustrade, plus removing all and any obvious visible damage to all communal doors at Mitre House and revarnishing, cleaning rubbing down and paint- ing in special rust proof gold metallic paint on all visible pipeworks on all floors - and probably quite a bit more that
