What Does the Data Show?
By reviewing our claims data, we can identify specific issues
or factors which contribute to a difficult defense, especially
in front of a jury. We refer to these issues or factors as
indefensibility issues because they often change a case that
would otherwise be defensible into one that is indefensible. The
four primary indefensibility issues observed are: communication,
medications, systems, and documentation. As seen from the
following graph, communication was the most prevalent risk
issue identified in all closed claims during the period 2015-2019.

A communication issue was identified in more than one-third
(34 percent) of the claims. The following chart shows the areas
