communication error or documentation error as these often go
hand-in-hand.
Physician-to-Patient Communication
Effective risk management is based
upon the four Cs – Compassion, Caring,
Competence, and Communication.
Some medical malpractice attorneys will
go so far as to say that even the most
compassionate, caring, and competent
physician can fall victim to a breakdown
in communication that leads to patient
harm and subsequently a claim for
negligent care.
Clear communication is key to the success of any relationship,
especially the physician-patient relationship. There are many
factors that may interfere with clear communication between
physicians and patients in today’s fast-paced environment.
Doctors are stressed. Many are dealing with large patient loads,
and it can seem that every day brings a new regulation or rule
to implement. Electronic health record (EHR) systems, although
intended to make the user’s life easier, are often the source
of stress and frustration and can distract attention away from
the patient. All this stress is permeated with the ever-present
concern about malpractice actions. Some stress is recognized
by the patient when the physician is hurriedly moving from
room to room, making that patient feel that the doctor has no
time to answer questions about the condition or treatment. A
lack of communication between patient and doctor may lead to
