28.1.14 Ang Thong Engineering Partnership Limited, in the case of a breach of contract for construction of the Company’s medical facilities. The amount totaling 5.66 million baht was sued. In this case, the Company won in the Court of First Instance, the Court of Appeals, and the Supreme Court. The Company has amortized the debt. The case is final and in the process of being discharged.
28.1.15 Direct Mail and Marketing (Thailand) Company Limited and an accomplice, a total of 2 people in the case of a breach of joint venture contract. The amount totaling 4.90 million baht was sued. In this case, the Company won in the Court of First Instance and the Company is in the process of amortizing debts because the legal enforcement period has expired.
28.2 Cases in which the Company is the defendant
The Company was sued in the disputes with individual persons and businesses mostly related to the breach of procurement agreement, construction agreement and employment agreement. Significant cases included :
28.2.1 V-Smart Company Limited and ICE Consulting Company Limited, in the case of cancellation of
Enterprise Resource Planning (ERP) system joint development contract. The amount of 432.32 million baht was sued. The Court of First Instance issued a verdict directing the Company to pay 24.70 million baht to the Defendant. At the same time, the Company has sued V-Smart Co., Ltd. in another case (see Note 27.1.1) and the court has ordered to merge cases. In the aforementioned case, the court issued a verdict directing V-Smart Co., Ltd. to pay 19.36 million baht to the Company. When deducted from money entitled to the Company, this leaves 5.34 million baht which the Company must pay to V-Smart Co., Ltd. The case is currently in the appeal process.
28.2.2 Ideal Systems (Thailand) Company Limited in the case of breach of Agreement for Development and Installation of Counter Automation Point of Sale (CA POS). The amount sued was 150.02 million baht. The case is in the process of the Court of First Instance. In this regard, the Company recognized the liabilities in the financial statements at 133.65 million baht.
28.2.3 Mr. Nipat Charoenkan in the case of requesting the court to revoke the order of termination of employment or dismissal and to order the Company to re-employ the plaintiff to work in the position of Head of Post Office. The amount sued was 68.41 million baht. In this case, the Company won in the Court of First Instance, the Court of Appeals, and the Supreme Court. The Company is in the process of proposing to the Company’s authorized executives to consider ending the matter.
28.2.4 Absolute Solution Co., Ltd., in the case of the development and installation of mail posting preparation system (Shipping Tool), sued the Company for wrongfully terminating the contract, causing the litigants to incur damages in the amount of 50 million baht. The case is in the process of litigation in the Court of First Instance.
28.2.5 Mr. Prasit Ketsamang and accomplices, a total of 5 people, in the case of violation of employment with Thailand Post, and the employer must be jointly liable with the employee in the course of employment, including Dhipaya Insurance Public Company Limited. The amount totaling 31.21 million baht was sued. The case is currently in litigation process at the Court of First Instance.
28.2.6 Mr. Kiat Chanthaisong, in the case requesting the court to revoke termination of employment or dismissal order and to accept the plaintiff back to work. The amount totaling 14.04 million baht was sued. In this case, the Company won in the Court of First Instance and the Court of Appeals. The Company is in the process of proposing to the Company’s authorized executives to consider ending the matter.
