การกําากับด้้แลการประกอบธุุรกิจของค์นต่่างด้้าว ในประเทศไทยเพิือให้้ปฏิบัต่ิต่ามพิระราชีบัญญัต่ิการประกอบ ธุุรกิจของค์นต่่างด้้าว พิ.ศ. 2542 แบ่งเป็นการต่รวจสือบ การประกอบธุุรกิจของค์นต่่างด้้าวทีได้้รับอนุญาต่ให้้ ประกอบธุุรกิจ ค์นต่่างด้้าวทีอาจประกอบธุุรกิจโด้ยไม่ได้้ รับอนุญาต่ และต่รวจสือบการถือหุ้้นแทนค์นต่่างด้้าวต่าม พิระราชีบัญญัต่ิการประกอบธุุรกิจของค์นต่่างด้้าว พิ.ศ. 2542

The regulatory framework for foreign business inspection to ensure that their business operation and activities are in full compliance with the Foreign Business Act B.E. 2542 (1999) is divided into :- Monitoring and Inspecting the Permitted Foreign Business Operation and Investigation into Illegal Nominee Shareholding to Circumvent the Foreign Business Act B.E. 2542 (1999)
การติดตามและตรวจสอบการประกอบธุรกิจของคนต่างด้าว
Monitoring and Inspecting the Permitted Foreign Business Operation
1.1 คนต่างด้าวทีได้รับอนุญาต จะต้องดําาเนินการตามกฎหมาย่ ดังนี
The statutory duties of the foreigners granted permission to do business in Thailand are:

1) ประกอบธุรกิจตามทีได้รับอนุญาต และภาย่ใต้ เง่อนไขทกี ําาหนด
โด้ยต่รวจสือบการประกอบธุุรกิจของค์นต่่างด้้าว ทีประกอบธุุรกิจค์รบ 1 ปี ว่าได้้มีการปฏิบัต่ิต่ามมาต่รา 8 และ กฎกระทรวง
• ประกอบธุุรกิจต่ามทีได้้รับอนุญาต่ห้รือไม่
• มีทุนขันต่ําาต่ามจําานวนทีกําาห้นด้ห้รือไม่
• อัต่ราสื่วนทุนต่่อเงินก้้ทีใชี้ในการประกอบธุุรกิจ
ทไี ด้ร้ บั อนญุ าต่อยใ้่ นเกณฑ์ไ์ มเ่ กนิ 7 เทา่ ของเงนิ ทนุ
• มีผ้้รับผิด้ชีอบธุุรกิจอย่างน้อย 1 ค์น มีภ้มิลําาเนา
อย่้ในราชีอาณาจักรไทยห้รือไม่
1) Operate business within the confines of permission and prescribed conditions.
The following is the inspection on foreigners with one full year of business operation into their compliance with Section 8 and the governing Ministerial Regulation.
• Dotheyoperatebusinessaspermitted?
• Do they have the minimum amount of capital as
required by law?
• Does the ratio of equity to borrowed funds used
in business operation higher than sevenfold of
the equity?
• Doestheforeignentityhaveatleastoneperson
in charge of the business residing in Thailand?

ประกอบธิรุ กจัิ ตามทไ้ ดิร้ บั อนุญุ าต แล้ะภัายใต้เง่อนุไขท้กําาห้นดิ Operate business within the confines of permission and prescribed conditions.
นุําาส่งทุุนุข้นุตําาเขุ้ามาประเทศไทย ตามจัําานวินแล้ะระยะเวิล้าทก้ ําาห้นดิ Execute inbound remittance of minimum capital as per the prescribed amount and time limit.
ดิําาเนินการตามแผนงาน การถ่ายทอดิเทค้ำโนโล้ย้ท้แจั้งไวิ้ Implement the technology transfer plan as earlier committed.
