POLICY AND PROCEDURE

POLICY

Hopess will act immediately if any resident is exposed to abuse, neglect, exploitation, or a
violation of rights.

PROCEDURE

A. Immediate Action

1. If abuse, neglect, or exploitation of a resident is alleged or suspected to have occurred on

    the premises, while the resident is receiving services from a behavioral health residential
    facility’s employee or personnel member, or suspected to have occurred before the resident
    was admitted or while the resident is not on the premises and not receiving services from
    a behavioral health residential facility’s employee or personnel member, an administrator
    shall immediately take action to stop the alleged or suspected abuse, neglect, or exploitation

    if such abusive, neglectful or exploitive acts are immediately founded.

2. Investigate as soon as possible after receiving an allegation.

B. Notification

1. Reports shall be made to Adult Protective Services or local law enforcement.

2. Notify the Bureau of Residential Facilities Licensing within twenty-four hours of receiving
    an allegation.

3. Submit a copy of the investigation report to the Department within fourteen working
    days.

C. Documentation

1. Develop a written investigation report of the investigation within forty-eight hours after
    receiving an allegation. The report must contain:
         a. Dates, times, and description of the alleged or suspected abuse, neglect, or
             exploitation.
         b. A description of any injury to the resident and any change to the resident’s
             physical, cognitive, functional, or emotional condition.
         c. Names of witnesses to the alleged or suspected abuse, neglect, or exploitation.
