Unwanted or unsolicited verbal conduct of a sexual nature, including requests or
propositions for a romantic or sexual relationship to an individual who has indicated in
any way that such conduct is unwelcome, references to sexual conduct, suggestive or
insulting comments about an individual’s body, and/or comments, inquiries or insults
about an individual’s sexual activities, deficiencies, libido, or prowess;
Unwanted verbal abuse or kidding that is sexually oriented and considered unacceptable
by another individual. This includes unwanted or unsolicited comments about an
individual’s body or appearance (where such comments go beyond a mere compliment);
Unwanted off-colored jokes that are clearly unwanted, or any other unwanted tasteless,
sexually-oriented comments, innuendoes, or offensive language of a sexual nature;
Unwelcome or unsolicited nonverbal conduct of a sexual nature, including the display
of sexually-suggestive objects, pictures or cartoons via e-mail, the Internet or text
messages; making sexually suggestive gestures; giving gifts or other items of a sexual
or personal nature; or
Any unwelcome sexually-oriented conduct that would unreasonably interfere with
another’s work performance, including whistling, leering, blocking a person’s path,
hindering a person’s movement, and/or deliberately or repeatedly invading a person’s
personal space by standing closer than appropriate.
Participating in the fostering of a work environment that is generally intimidating,
hostile, or offensive because of unwanted or unsolicited physical, verbal and/or non-
verbal conduct of a sexual nature.
Sexual harassment is a behavior that demeans the individual being treated in the inappropriate manner.
Consequently, the LSBA will not tolerate and expressly prohibits sexual harassment directed toward its
applicants, Employees, volunteers, Members, contractors, vendors, Members, or visitors by any
individual. The LSBA will, as necessary, take disciplinary action, up to and including termination, in
accordance with this policy to ensure that the LSBA meets its responsibilities to its Employees and
other individuals who are associated, or conducting business, with the LSBA.
Although the intent of the person engaging in the conduct may be harmless or (from their point of
view) even friendly, it is whether the recipient welcomes the conduct, not the intent of the person
engaging in the conduct, that determines whether the conduct is harassment in violation of this policy.
Unwanted sexual conduct may not always be apparent. “Putting up with” or submission to sexual
conduct does not necessarily mean the conduct is welcome.
Sexually harassing conduct in violation of this policy includes any prohibited, unwelcome or
unsolicited conduct of a sexual nature by a person of either the same or opposite sex as the person who
is the subject of the harassment. Other unwelcome conduct directed at an individual because of his or
her gender may also be deemed to be sexual harassment under this policy. Sexual harassment under
this policy may occur even in relationships involving mutual consent.
