Proposed GPS bill in Utah (HB 0223 Unlawful Installation of a Tracking Device) - PIs Protected!
Editor’s Note: during layout, Regional Director Tina Thomas notified the Board of this development from PIAU Michelle
Palmer – “We Won!”. The original bill included, specifically, that it “makes it a class A misdemeanor for a person or
licensed private investigator to unlawfully install a tracking device”. The amended version has struck ‘or licensed private
investigator’ from the bill.
This history from January and February this year…
PIAU Legislative Chair Michelle Palmer spoke with the Police Chief’s Association and prosecutors. The bill is currently on
hold in the Rules Committee, where proposed changes and substitutions to the bill by PIAU were provided. Wes
Bearden, NCISS Legislative Chair – Investigations, provided a letter supporting PIAU’s position. Since these discussions,
the Utah Law Enforcement Legislative Committee has pulled support for the bill; it is anticipated the Utah Prosecutors
Association will remove their support. The President of the Criminal Defense Attorneys that will speak on behalf of PIAU.
In the meantime, my office has been busy tracking down some potentially helpful case law. We also put together a list
of states that allow and do not allow private investigators to use GPS. Please share any GPS law information for your
state to Tina Thomas, Region 5 Director.

community members that I’ve had the pleasure of getting to know through the years. I am
humbled and honored by the recognition and I certainly want to pay gratitude to my parents,
who started this company and allowed me the opportunity to continue on their legacy.”
