DP163.6a (a) The organization determines, in conjunction with the requesting party, that
the PHI sought is relevant and material to a legitimate law enforcement
inquiry;
DP163.6b (b) The organization determines, in conjunction with the requesting party, that
the request is specific and limited in scope to the extent reasonably practicable in
light of the purpose for which the PHI is sought.
DP163.6c (c) The organization determines, in conjunction with the requesting party, that
de‐identified information could not reasonably be used.
Employees and DP163.7 The organization may disclose the following PHI in response to a law

to PHI or locating a suspect, fugitive, material witness, or missing person, provided that
the organization only discloses the following:

Employees and others DP163.8 The organization may disclose to a law enforcement official PHI that the
with Access to PHI organization believes in good faith constitutes evidence of criminal conduct that
occurred on the premises of the organization.
Employees and others DP163.9 The organization may, in providing emergency health care in response to a
with Access to PHI medical emergency, other than emergency care provided on the premises
of the organization, disclose PHI to a law enforcement official if such
disclosure appears necessary to alert law enforcement to:
DP163.9a (a) the commission and nature of a crime;
DP163.9b (b) location of such crime or of the victims of such crime; and
DP163.9c (c) the identity, description, and location of the perpetrator of such crime.
Employees and others DP163.10 The organization may disclose PHI in response to a law enforcement official’s
with Access to PHI request for such information about a participant who is or is suspected to be a
victim of a crime if the participant agrees to the disclosure.
Employees and others DP163.11 In cases where the participant is suspected to be a victim of a crime and where
with Access to PHI the organization is unable to obtain the participant’s agreement because of
incapacity of other emergency circumstance, the organization will:
DP163.11a (a) Obtain representation from the requested law enforcement official that
such information is needed to determine whether a violation of law by a
person other than the victim occurred, and such information is not
intened to be used against the victim;
DP163.11b (b) obtain representation from the law enforcement official that immediate law
enforcement activity that depends upon the disclosure would be materially
and adversely affected by waiting until the participant is able to agree to the
disclosure; and
