Void Contracts
Case:
On January 4, 2020, Ronald Coloma sold his hotel in favor of
Spouses Leo and Vanessa Yu. A deed of sale was executed but Spouses Yu
named Johnny Yu (their unborn son) as the buyer in the contract of sale.
Accordingly, Johnny Yu was named as the buyer in the deed of sale by
virtue of a Chinese custom naming children as the heir of their parents‘
properties. It was only on March 1, 2020 that Johnny Yu was born.
