(d) Duration of covers and conditions of carriers legal
liability insurance -
Ans. the cover is during transit, incidental storage, trans-
shipments and up to 7 days after reaching the final place.
Conditions: (a) the vehicle should be maintained in road-
worthy condition. (b) vehicle should be insured for motor
comprehensive risk at all times during the currency of
the policy. The insurer should not be changed in between
the term. (c) on payment of a loss, the sum insured is to
be reinstated.
The policy follows the coverage under a road transit
marine insurance.

Under the common law, the burden of proving negligence
rests with the person who has suffered the injury or
damage. In other words, he has to establish that the
defendant owed him a duty of care, and that this duty
was breached and the breach was the proximate cause
of the injury or damage. However, circumstances
surrounding the accident may be such as to lead to a
