Q1. What is MACT? Define the jurisdiction of MACT
in deciding the claims cases.
Ans: MACT is an abbreviation stands for 'Motor Accident
Claims Tribunal' constituted under section 165 M VAct,
1988 for the purpose of adjudicating upon claims for
compensation in respect of accidents involving the death
of, or bodily injury to persons arising out of the use of
motor vehicles, or damage to any property of third party
so arising, or both.
However, option was available to those persons where
death of or bodily injury gives rise to a claim for
compensation under this Act and also under Employees
(Workman) Compensation Act, 1923, the person entitled
to claim compensation may claim such compensation
under either of those Acts but not under both.
In addition to the above, Section 175 of the M V Act,
1988 creates bar on jurisdiction of Civil Courts, thereby
vesting exclusive jurisdiction with the MACT to deal
with third party claims.
Such tribunals are presided over by a person of the rank
of a District Judge or High Court Judge. Only a nominal
fee has to be paid for instituting a case. All third party
claims for personal injury and property damage up to
Rs. 6000/- have to be filed with claims tribunals.
