Ans : What is the procedure for recovery of money from
insurer in case the award is not satisfied?
Yes, section 174 M V Act, 1988 provides the procedure
for recovery of money from insurer in pursuance to non-
satisfaction of an award as under; Where any amount
is due from any person under an award, the Claims
Tribunal on an application made to it by the person
entitled to the amount, issue a certificate for the amount
to the Collector and the Collector shall proceed to
recover the same in the manner as an arrear of land
revenue.
Q10. What is the procedure for appeal against the order
Ans: of the Claims Tribunal?
Any person aggrieved by an award of a Claims Tribunal
can prefer an appeal to the High Court u/s 173 M. V.
Act, 1988. But, no appeal can be filed where by the
amount in dispute is less than Rs.10,000.
However, the person preferring appeal required to
deposits with the High Court Rs. 25,000/- or 50%
whichever is less.
