Q6. Describe the procedure followed by the tribunal
for passing of an award? Section 168 M V Act
laid down the procedure to be followed by the
Tribunal on receipt of an application for
compensation.
Ans. On receipt of an application the Tribunal shall issue notice
to the insurer, also afford an opportunity of being heard,
hold an enquiry into the claim and determine the amount
of compensation which appears to be just and reasonable
and also apportion the rights and liabilities amongst the
claimants and tort-feasors respectively.
That the Claims Tribunal shall arrange to deliver copies
of the Award to the parties concerned expeditiously, and
in any case within a period of fifteen days from the
date of the award.
Q7. Whether the Tribunal can order for payment of
interest on compensation?
Ans: Yes, section 171 M V Act, 1988 empowers the Claims
Tribunal to order for payment of simple interest at such
rates as it thinks fit, from such date not earlier than the
date of making the claim.
Q8. Is there any time limit for satisfaction of the
award?
Ans : Yes, When an Award is made, the judgment debtor shall
