I contend that:
there was and is no Objectively Assessed Need (OAN) for the massive, out-of-
character development of the WH sites and no current market demand for them:
the lurking scheme for a further 25+ flats is a material consideration in the
current applications; you have repeatedly refused to address this:
The Ashurst Wood Neighbourhood Plan (AWNP) is defective and most likely
unlawful; among other things because the referendum that approved it was misled;
The developer has not complied with the requirement (see paragraph 2 below) to
produce an independent viability assessment, a supplementary planning document
and up to date market survey. Thus the notice is premature.
For reasons unknown, MSDC has fixated on progressing the WH:EDF applications, contrary
to the National Planning Policy Guidelines, ancillary papers and the Development Plan. This
has involved an appalling lack of consultation, validating documentation in advance, holding
critical and meetings with the developer that were not minuted nor recorded on
the MSDC Planning Portal, as well as other serious breaches of process. These could amount
to misfeasance in public office.
1. A BRIEF HISTORY OF THE CURRENT APPLICATION
Applications DM/16/2845, DM/18/1548 and DM/19/1025 have progressed as follows;
October 2016, a pre-application consultation (DM/16/2845) with Mr Steven King of
MSDC by GCP Developments Ltd to build 90 mixed units. This was not supported;

On 13 April 2018 an application by AHL to build 71, 4 storey flats of which 22 were to

be affordable. MSDC improperly validated the application on 14 April 2018 in advance
of receiving the necessary documentation and without reference to Ashurst Wood Village
Council (AWVC). The application was required to be withdrawn to allow a public
consultation to take place;

On 19 April 2018, a revised application was prepared showing AHL and GCP
Development Ltd as joint applicants. GCP pre-application meeting of October 2016 was
disingenuously misrepresented as being the necessary public consultation. AWVC and
MSDC did not accept this;

On 29 May 2018, a public consultation was held in Ashurst Wood Village Hall and on

7 June 2018 the application was verified by MSDC and added to its Planning Portal on
th
11 June 2018;

This was rejected out of hand by Ashurst Wood Village Council (AWVC) on 2 July 2018;
