Operating Guide for the JNN-Q25 Voice Recorder

              1    INTRODUCTION

              1.1   Exceptional performance
              The JNN-Q25 recorder is a superb device with exceptional audio quality and many
              powerful features including voice activation, delayed recording, massive memory and an
              excellent DISPLAY. It compares favorably with recorders costing more than five times as
              much.                                                                                      Page | 2
              Unfortunately, the instructions provided by the manufacturer (Attachment 1) are sometimes
              misleading and the software can be erratic, especially for, settings, voice activation (VOX)
                        1
              and automatic recording (see paragraph xx).

                      If you plan to use the device covertly, or in a way recordings might be produced in court,
                      you are strongly advised to read this booklet line by line and test each operation. This will
                      ensure you get the maximum benefit from your JNN-Q25 and don’t get into trouble by using
                      it.
              1.2 Using the device as a standard recorder
              The device can function as a simple recorder by using only the ON-OFF switch and A(+)
              and B(-) buttons. This is the recommended method for most users and in most
              circumstances.
                      Do not modify the default settings unless there is a good reason to do so.

              1.3   Lawful and ethical recording
              It is lawful and ethical to use the device openly (“overtly”) – in almost all countries – to
              record with the knowledge of the people present. Even for overt recording of routine
              meetings and lectures, permission should be obtained from the senior person present.

              It is permissible in the UK and most other countries to use the device “covertly” without the
              knowledge of the people being recorded. This is usually known as “single party
              authorisation” and it is both legal and lawful. The position is less clear for a recording when
              none of the people present are aware of it.
                      Always risk assess (see Appendix xx) the benefits of covert recording and the potential
                      consequences. Work on the basis that the recording will be revealed and forensically
                      examined in a court.
              The Verbal Judo Tongue Fu (VJTF) program (Attachment xx) identifies the countries in
              which single party authorisation and covert recording are allowed. It also explains optimum
              placement of the device, how to enhance and transcribe recordings and to ensure your
              objectives are achieved.

              Important points from the VJTF program include:
              • Assume, especially in contentious cases, that your opponents will covertly record
                  interviews, telephone other conversations and that these may be produced in evidence;

              • A court will decide – on a case by case basis - whether a recording is lawful and
                  admissible in evidence or not;
                  ~ The relevance of the recording, its purpose, probity, fairness and whether admission
                      is in the interests of justice;

              be different.
