          Dentists Authorized to Administer COVID Vaccine

          On December 13, Governor Cuomo issued Executive Order #202.82 authorizing dentists to administer novel
          coronavirus (COVID-19) and influenza vaccinations at designated vaccination sites supervised by either a physician,
          nurse practitioner, or physician assistant.  The order also applies to dental students and to dental hygienists (the
          dental hygienist must be certified to perform local infiltration anesthesia/nitrous oxide).  To read Governor Cuomo's

          Other Bills introduced that NYSDA is monitoring:
          On November 6, Assemblyman Stirpe introduced the same bill -- A.11131 -- as Senator Kaplan had introduce in May
          -- S.8394 -- to exempt personal protective equipment (PPE) from sales tax.  NYSDA supports the bills.

          On November 2, Senator Kaplan introduced -- S.9078 -- exempting small businesses from sales taxes for purchasing
          materials necessitated by COVID-19 reopening guidelines and establishing a sales tax credit system to recover any
          sales tax paid on such items.  NYSDA supports the bills.

          On October 20, the New York State Department of Labor issued its long-awaited guidance on the New York State
          Paid Sick Leave Law, which guidance can be accessed here: New York State Paid Sick Leave Guidance.

          On October 19, Senator Gounardes introduces bill S.9058 to provide a tax credit for small businesses to purchase
          personal protective equipment.  This is the second such bill NYSDA supports on this concept.

          On October 18, Governor Cuomo has issued the draft New York State COVID-19 Vaccination Program calling on
          enrolling dentists as persons capable of administering the vaccine.  You can access the complete draft New York

          On October 16, the New York State Board of Regents has issued its 2021 proposed legislative and State Budget
          priorities for the Office of the Professions, which include: 1) expanding the authority of the Office of
          Professional Discipline [OPD]; 2) $7.85 million in funding for its electronic professional licensing system; and 3)
          collecting health care workforce census data as part of the licensing process.

          Senator Persaud introduces bill S.9034 on October 7 to require disclosure of OPD actions to patients, including
          probation, via signed written statements.  NYSDA opposes the bill, as does the Title VIII coalition of the professions,
          as unwarranted overkill violating basic due process.

          Assemblyman Gottfried introduces bill on October 7 to license dental therapists -- A.11003 -- the same as Senator
          Biaggi's bill S.7935.  NYSDA had been alerted in advance that Assemblyman Gottfried would do this, but the bill is
          not expected to be advanced out of committee.  NYSDA will be opposing this unnecessary legislation.
