Employee practices
1.1 Recruitment and selection
Issues such as age, sex, race or religion are, on the whole, irrelevant.
Unfair discrimination can be avoided by recruiting and selecting based on the
best person to perform the role.
1.2 Dismissal
Dismissal is termination of a worker’s employment by the employer.
When analysing whether dismissal is fair or a breach of contract consider:
Breach of Another
Conduct Capability statutory reason, e.g. Redundancy
duty dishonesty
Some reasons will be classed as grounds for unfair dismissal. In
the UK this would relate to, for example, dismissal on the grounds
of race, sex, pregnancy or due to a request for flexible working
practices.
Constructive dismissal involves the employee resigning because
the employer has made matters so difficult for them which equates
with having in effect terminated their contract of employment.
