distance and very quickly as the IV was turning towards the

               driver’s side.

























               As explained with suitable references above, fall from height

               is the major cause of truck driver injuries. Hence, he could


               not have escaped unhurt from the alleged accident as he

               would not have the time to jump that far so as to clear the


               turning IV and avoid hitting the wheels and undercarriage and

               escape from getting crushed under the turning vehicle.




               Q.  But  the  driver  alleges  that  he  had  injury  sustained


               due to jump from IV. Pl opine of the same.

               The alleged driver has congenital stenosis of lumbar spine and


               has alleged that the back pain is due to the RTA.

               However  as  per  medical  documents,  there  is  no  sign  of  any


               external  injury  which  should  have  been  present  if  he  had

               jumped out of the IV.

               In addition as explained with suitable references above, when


               the driver jumps out of a moving truck, the force of impact
