• Commercial leases generally do not give start and end dates.
• The delivery date is referred to as the date the landlord finishes their work (if any is required)
and hands over the keys to the tenant.
• Tenant is then generally given a time frame to complete their build-out (generally 90 – 120
days).
• The rent commencement date will usually be the earlier of completion of tenant’s build-out (or
Certificate of Occupancy) or the day tenant opens for business.
• The lease end date is usually extended to the last day of the month.
• Many commercial leases include a commencement agreement as an exhibit in the back of the
lease. A commencement agreement is often needed to memorialize the start and end dates of
the lease.
