1.4.2.3  Not Applicable 1.4.2.4 If the  delivery of Party B fails to meet the

                    construction progress of Party A's project, Party B shall make compensation for
                    Party A's loss.



                    1.5 Termination of contract

                    1.5.1 Party A may request to terminate the Contract in any of the following cases:

                    1.5.1.1 The project is suspended, the construction contract is terminated or the
                    project is subject to a major change in design; Party  B should acquire
                    corresponding compensation, the maximum compensation does not exceed 10%
                    of the total contract price.

                    1.5.1.2 The contract object is not applicable for the project or does not meet the
                    quality standards and technical requirements upon inspection and testing; If
                    negotiation between both parties is invalid, Party A has right to terminate the
                    contract.

                    1.5.1.3 Party B shall ensure its design drawings and the qualification performance
                    regarding the Tank of Package-V project to be approved by PLN. If the design
                    drawings provided by Party B or the qualification performance are not approved
                    by PLN in the contract required time, this contract is void and Party B shall bear
                    all the expenses incurred by himself.

                    1.5.1.4 If Party A breaks the contract, (such as payment terms), and negotiation
                    between both parties is invalid, Party B has the right to suspend and terminate
                    this contract.

                    1.5.2 Party A shall issue a written notice to Party B when it requests to terminate
                    the Contract and such termination shall not exempt Party B from the liability for
                    breach of contract.

                    1.5.3 The termination of the Contract  does not affect effectiveness of the
                    settlement and liquidation terms in the Contract.



                    1.6 Force majeure

                    1.6.1 If Party A or Party B is unable to perform the Contract due to force majeure,
                    Party A or Party B shall inform the other party of the reasons in a timely manner.
                    Extended performance, partial performance or nonperformance of the Contract is
                    allowed if proved by the relevant authorities and the liability for breach of
                    contract may be waived partially or completely as appropriate.
