               2.2     Application


               The CIMAH requirements are only applicable to industrial activities that are classified in
               the Regulation as MHI. Installations, which are mentioned in Part 1, under item 3 of the
               Regulations, are not required to conform to the requirements of the Regulations. The
               industries exempted from the regulations are as follows:

               a. A nuclear installation;
               b. An installation under the armed forces;
               c. A vehicle or  vessel transporting hazardous substance to or  from the  site of  an
                  industrial activity; and
               d. An industrial activity in which  it  is involved or likely to be involved a quantity of
                  hazardous substance  or a category or categories of substances  which is equal or
                  less than 10 % of the threshold quantity of the hazardous substances.

               An installation that involved in the handling, storage and usage of hazardous
               substances is  categorized  as MHI if the  amount of  hazardous substances  on-site
               exceeded the threshold quantity, therefore requires complying  with the CIMAH
               Regulations 1996 by submitting the Safety Report and  Emergency Response Plan
               (ERP) to DOSH. However, for installation  which involved in handling a quantity of
               hazardous substance that is more than 10% of the threshold quantity but less than the
               threshold quantity of the hazardous substance is categorized as non-MHI.

               Under the regulations, every manufacturer is required to notify to DOSH of the
               installation
               operations activities within his control by completing the Notification of Industrial Activity
               Form and submitting it to DOSH. Upon receiving the Notification form, DOSH will then
               determine the status of the installation i.e.-Major Hazard Installation (MHI) or non-Major
               Hazard Installation (non-MHl).

               In this industrial activity report, Chlorine is being used as an disinfectant in the water
               treatment process  and  the amount of Chlorine on-site has  exceeded  the threshold
               quantity limit of 10 tonnes. Thus, the installation is classified as MHI requiring the full
               compliance  to CIMAH Regulations  1996.  Under the requirements of the Regulations,
               this report or an updated version (if necessary) is to be submitted every subsequent 3
               years or 3 months before the start of operation of any modification or expansion for the
               plant.
