If the husband is aware that this act is forbidden during the daytime in Ramadan and coerces his wife to have intercourse nonetheless, he will have committed a big transgression and he must make up the day and offer an expiation.Maaliki states that he must offer expiation for himself and for his wife as well.What is the ruling for a man who has intercourse with his wife during the daytime in Ramadan out of forgetfulness?The man does not have to offer expiation if intercourse happens out of forgetfulness. This is the opinion of the majority from the Hanafi%u2019s, Maaliki%u2019s, Shafa%u2019is, and a report by Imam Ahmad that was chosen by Shaykh aIslam ibn Taymiyyah, ibn al-Qayyim, al-San%u2019ani, and al-Showkani.As for the requirement of making up the day, there is a difference of opinion on the matter:The majority of the scholars state that he does not have to make up that day. [Hanafi%u2019s, Shafa%u2019is, and a report by Imam Ahmad that was chosen by Shaykh al-Islam ibn Taymiyyah, ibn al-Qayyim, al-San%u2019ani, and al-Showkani]Maaliki%u2019s and Hanbali%u2019s state that he must make up the day, and that is the most cautious opinion. And Allah the Exalted knows best.What is the ruling for one who repeats intercourse in Ramadan?Whoever repeats intercourse in the same day, one expiation will be sufficient for him; this is without any disagreement amongst the scholars.This is because he invalidated his day%u2019s fast by having intercourse the first time; therefore, if he has intercourse again, he does so upon a fast that has already been invalidated. One expiation would thus suffice for making up that dayDoes the expiation for intercourse during the daytime in Ramadan have to be offered immediately, or can one take his time in offering it?Expiation is an immediate obligation and it is not permissible to delay it except with a valid excuse.One who is required to offer expiation due to intercourse should be cautious not to delay it until the next Ramadan without a valid excuse.Copyright %u00a9 2023 Islamic Association of Raleigh.
