It is to be noted that the Court’s decision on the
counterclaim only considered the amount of QR178 million
which was already certified by Ashghal and a
compensation of QR30 million for Ashghal’s failure to pay
such amount. The Court did not allow any of the other
parts of the counterclaim which was for losses suffered by
UEM.
UEM views that the Court was erroneous in deciding that
UEM is liable to pay Ashghal as UEM is not responsible
for the damage to the Highway. The Court also
erroneously decided that UEM is to pay liquidated
damages for stoppage of works notwithstanding the fact
that UEM was given an Extension of Time until the date of
completion of the Highway.
Ashghal and Parsons filed an appeal on 10 August 2017.
UEM filed its appeal on 16 August 2017. The Court of
Appeal has started the hearings on the appeal on 15
October 2017, 7 January 2018 and 19 March 2018.
On 27 May 2018, the Court of Appeal has decided to
adjourn the matter until 2 December 2018, for the other
parties to respond and to consolidate the case file from the
Court of First Instance.
On 13 Feb 2019, the new Executive Director and Board
member of UEM Group Berhad, YBhg Dato’ Mohd Izani
Ghani met with HE Dr. Eng. Saad bin Ahmad Al
Muhannadi, President of the Public Works Authority
(ASHGHAL) at the President's office.
During the meeting, the President agreed for both sides to
resolve the issues through negotiation. He proposed for
both parties to meet and settle the dispute in order to
move forward.
