Abstract

This article describes the historical background and the legislative process of
the Civil Partnership Bill, along with details of each section. The Draft Bill aims to
entitle same-sex couples with the right to family formation through civil partnership

registration, which allows them to enjoy the same legal treatment as opposite-sex
couples. The Draft Bill contains 46 sections, including general provisions on the mutatis

mutandis application of the Civil and Commercial Code Book 5 Family, which aims to
provide the same standard of treatment to civil partners, particularly on their property,
debt, and finances after separation. Moreover, five sections in the Civil and Commercial

Code Book 5 Family are going to be amended in accordance with the Civil Partnership
Draft Bill. The Civil Partnership Bill, once enacted, will affirm that Thailand accepts

the new form of family and treats same-sex couples equally under the law.
