Searches and seizures
• Searches and seizures are one of the most highly litigated areas of
criminal procedure.
• The Fourth Amendment forbids the government from performing
unreasonable intrusions of privacy or control over a person or property.
• The exclusionary rule states that evidence obtained by an
unconstitutional search or seizure is not admissible as proof of guilt. Any
other evidence acquired as a result of the initial unconstitutional search
or seizure must also be excluded.
• A warrant is usually required before undertaking a search or seizure.
