Mistake #1: Ignoring the salary threshold,
especially now that may double what it was prior to
December, 2016. If you remember only one thing,
remember that anyone making less than the applicable
threshold per week is not exempt. Even if they are the
CEO.
Mistake #2: Putting too much faith in titles. If
someone is called a manager but spends the majority of
their time doing the same work as the people they
supervise, they may not be considered exempt.
Mistake #3: Assuming that any workers who are
paid on a salary basis are exempt from overtime. Salaried
workers are only exempt from overtime if (i) they earn a
certain amount of money each pay period regardless of
hours worked; (ii) the amount they earn is above the
