just one day, the company was still responsible to
pay triple damages and her attorneys’ fees.
An out of state staffing company had a
Massachusetts office, and paid its employees
pursuant to the laws and policies of its home state.
Specifically, that company’s policy was to pay
employees seven days after the end of the prior
pay period, and to withhold accrued, unused
vacation time if the employee resigned without
giving two weeks’ notice. A Massachusetts
employee resigned without the required notice, and
was not paid vacation time. This unintentional
mistake cost the company an amount equal to
almost two months of that employee’s salary, plus
the company’s own legal fees.
